depending on the state, and whether or not he had been arrested at the time, reading a person's
private text messages without a warrant may have been illegal. search and seizure falls under the
fourth amendment and generally people have the right to be secure from searches without a warrant.
that right is a little different following an arrest.

in this case, i'm guessing it will be kicked before going to court.
