rhcp is one of my favorite rock bands, but this is just wrong.
\'californication\' was coined back in the 1940\'s, before rhcp were even
born. i
see no connection between the tv show and the song. i hope they realize their
stupidity before it damages showtime.

red hot chili peppers shoot themselves in the foot with their own argument.

if, indeed, the word "californication" is as "inherently distinctive"
and "famous" as the rhcp claim ... then it is now considered an expression of
popular culture - meaning you dont even need to know of the song or band to
understand the meaning of the word. as too, the song "dani california" is
recognised by at least 14 million rhcp fans, bringing it into popular culture
also.

as such, any copyright material that is recognised as popular culture (say like
a cambells soup tin) is open to "artistic comment" and parody, as long as it
does not make up the majority of the artwork. it's called pop art and
permeates every form of artistic expression. for the same reason, a music
artist can legally sample 5 seconds of copyright audio, without permission or
royalties, for use in a song. another example would be movies that parody
other movies.

the show's utilisation of the popularised word "californication" (and even the
character "dani california" ) can be considered "artistic comment" because
people easily identify with it's meaning as a lifestyle and culture, not just
as a rhcp song. critical acclaim of the show, and its subsequent public
success, proves artistic value of the content way beyond the title of the show
and the name of one character. it could have been called "spit" and still
been successful. in fact, it is the content of the show itself which proves
undoubtly that the program was intended to be an artistic statement on "popular
culture" in california.

the decision by rhcp to wait until the series completed airing before suing for
everything, is blatant greed and a grave mistake. if they had asked for a
percentage cut, they would have retained my respect. for me, this action places
them in the same vain as the greedy fan hating metallica. i hope this law suit
costs them a bundle, only to lose.

i am disgusted in myself for paying to go to their concerts and buying their
albums, while having downloaded the "californication" tv show. on artistic
principal, the rhcp will not get another cent from it's fan base in this
household of 10 people ... though we will be proud owners of
the "californication" dvd boxset of the show when it is released, as long as
the profits go to those who rightfully earned it.

californication is a portmanteau of california and fornication, written about
in time on august 21, 1972 and seen on bumper stickers in the u.s. states of
colorado, oregon, idaho,[1] and washington.[2] it refers primarily to
a "haphazard, mindless development that has already gobbled up most of southern
california",[3] which some attribute to an influx of californians to other
states in the western u.s.

i hope the chili peppers win so time can sue their butts off for stealing the
name from them.

it does seem like a really weak grab for more fame and money, they are
basically claiming they made the word famous, so the show plays off that fame,
but the show is not about rock and roll, or about music, so the show really is
using the earlier meaning/version of the word, which means i don't think the
band has a chance of anything here but looking stupid.

to be honest i had forgotten all about the bands album when i started watching
the show, so never made the link, chances are most other people never made the
link either, it's not an obvious link.

sounds like karma is at work though, did not one of their band members house
burn down yesterday???

it's red hot chilli fever in this thread.

still, it's disappointing of them to judge their ip rights only as far as a
show makes money. if it'd sunk to nothing then they wouldn't have cared about
the money...er, rights! it's all about what's yours, kids. apparantly, rhcp's
own words.

i know they used the word and in one of their songs. one of my books has that
in the title. *bites nails* i guess i'll wait for the legal notice.
